DealSmart AI Terms of Service

1. Acceptance

By texting, chatting, or otherwise communicating with a participating dealership through DealSmart AI, you agree to these Terms and our Privacy Policy.

2. Messaging Consent & Frequency

• By submitting your contact information on a dealer or partner site or initiating chat/text communication, you consent to receive automated or AI-assisted messages from that dealership and DealSmart AI.
• Consent is not a condition of purchase.
• Reply STOP to cancel or HELP for support. Typical frequency ≤ 4 msgs/mo. Msg & data rates may apply.

3. Service Description

DealSmart AI enables dealerships to communicate via SMS, MMS, chat, voice, and email for lead responses, test-drive reminders, service updates, and related communications.

4. User Conduct

You agree not to misuse the platform, transmit fraudulent content, or interfere with operations. Violation may result in suspension or termination.

5. AI Transparency

Some responses may be AI-generated. You can request human review at any time.

6. Privacy

Our data practices are governed by the DealSmart AI Privacy Policy.

7. Limitation of Liability

DealSmart AI provides its services "as is." We are not responsible for dealership inventory, offers, or transactions. To the fullest extent allowed by law, we disclaim liability for indirect or consequential damages.

8. Indemnification

You agree to indemnify and hold harmless DealSmart AI and its affiliates from claims arising from misuse of the service or breach of these Terms.

9. Dispute Resolution & Governing Law

These Terms are governed by Delaware law. Any dispute shall be resolved exclusively in state or federal courts located in Delaware, USA.

10. Termination

We may suspend or terminate access for any violation of these Terms or applicable law.

11. Modifications

We may update these Terms from time to time; continued use after updates constitutes acceptance.
