By accessing or using the DealSmart AI platform, communicating with a dealership through our services, or submitting information through our website, you agree to be bound by these Terms of Service and our Privacy Policy. Messaging Consent
By providing your phone number and engaging with our platform, you consent to receive automated or AI-assisted messages from DealSmart AI on behalf of participating dealerships. These messages may include appointment confirmations, service reminders, follow-up communications, and promotional offers. Consent to receive messages is not a condition of purchase. You may opt out at any time by replying STOP to any message. Reply HELP for support. Standard message and data rates from your mobile carrier may apply. Message frequency varies based on your interactions.
Description of Service
DealSmart AI provides an autonomous communication platform that enables automotive dealerships to engage with customers via SMS, chat, voice, and email. Our services include automated lead response, appointment scheduling and management, service department communications, and follow-up sequences. The platform uses artificial intelligence to generate responses, schedule appointments, and manage customer interactions on behalf of dealerships. DealSmart AI acts as a technology provider and is not a party to any transaction between you and a dealership.
AI Transparency
Some or all responses you receive through DealSmart AI may be generated or assisted by artificial intelligence. While our AI is designed to provide accurate and helpful information, AI-generated responses may occasionally contain errors or inaccuracies. You may request to speak with a human representative at any time during your interaction. The dealership is ultimately responsible for the accuracy of inventory, pricing, and promotional information communicated through our platform.
Limitation of Liability
DealSmart AI provides its services on an as-is and as-available basis without warranties of any kind, either express or implied. We are not responsible for dealership inventory availability, pricing accuracy, promotional offers, or the outcome of any transaction between you and a dealership. In no event shall DealSmart AI be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount you paid to us in the twelve months preceding the claim.
Governing Law
These terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from or related to these terms or your use of our services shall be resolved exclusively in the state or federal courts located in Delaware. By using our services, you consent to the personal jurisdiction of these courts.
